Mediation — An Affordable Alternative To Litigation

It can be expensive, time-consuming and stressful to take child custody, parenting time and property issues to trial. Mediation is a cost-effective alternative that allows you to work toward settling your disagreements while avoiding the expense, time and aggravation of a protracted courtroom battle. It is also a valuable way to minimize the emotional burden of divorce and preserve fragile family relationships.

From offices in Freehold and Red Bank, LaRocca Hornik Rosen Greenberg & Crupi, LLC assists individuals and families in Monmouth County, Ocean County, Middlesex County and central New Jersey in resolving family law matters through mediation.

In most cases involving mediation, clients end up settling their differences and feeling satisfied because they are directly involved in the outcome. However, in circumstances where the relationship between both parties makes mediation impossible or unsuccessful, our attorneys’ decades of litigation and trial experience work to your advantage. If mediation is not appropriate given the circumstances, we will zealously and effectively fight for you in court.

The Mediation Process

In mediation, both parties and their attorneys work with a mediator to negotiate a settlement both can agree on. The mediator assists both parties in coming to a resolution, usually by sending offers of settlement back and forth between both parties. The mediator does not make a final decision or give advice to either party. If some contested issues remain post- mediation, the parties are free to continue settlement negotiations through their attorneys and/or prepare to resolve the case at trial.

Any individual who attends a mediation without an attorney is at a significant disadvantage. During the mediation, attorneys play a critical role in protecting your interests and advising you on the fairness of potential settlement offers.

The Advantages Of Mediation

Mediation provides numerous advantages in an uncontested divorce, including:

  • Eliminating the uncertainty of a court case by giving you control over the end result rather than having a judge issue a ruling
  • Allowing you to resolve issues in a private setting rather than a courtroom
  • Providing you a shorter, less formal proceeding than a trial — saving you money
  • Allowing both sides to leave with less stress and a better working relationship as you co-parent your children
